Welcome to S.O.I.L (School of Infinite Learning), a donation platform operated by Prajaahita Foundation, a registered non-profit organization dedicated to inclusive education and empowerment of children with disabilities.

These Terms and Conditions outline the rules and regulations for the use of our Platform. By accessing this website and making donations, you accept these terms and conditions in full. Do not continue to use S.O.I.L's Platform if you do not accept all of the terms and conditions stated on this page.

Acceptance of Terms

By accessing and using the S.O.I.L (School of Infinite Learning) platform operated by Prajaahita Foundation, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services. These Terms and Conditions govern your use of our website, mobile applications, and all related services (collectively, the "Platform"). We reserve the right to modify these terms at any time, and your continued use of the Platform constitutes acceptance of those changes.

User Eligibility and Account

**Eligibility Requirements:** - You must be at least 18 years of age to create an account and make donations - If you are under 18, you may use the Platform only with the involvement of a parent or guardian - You must provide accurate, current, and complete information during registration - You are responsible for maintaining the confidentiality of your account credentials - You agree to notify us immediately of any unauthorized use of your account **Account Responsibilities:** - You are responsible for all activities that occur under your account - You must not share your account credentials with others - You must not create multiple accounts for fraudulent purposes - We reserve the right to suspend or terminate accounts that violate these terms

Donations and Payments

**Donation Terms:** - All donations made through our Platform are voluntary contributions to Prajaahita Foundation - Donations are generally non-refundable except as specified in our Refund Policy - You acknowledge that donations will be used for the programs and initiatives of S.O.I.L - Minimum donation amount is ₹10, maximum is ₹1,00,000 per transaction - We do not guarantee that donations will be used for specific individuals or purposes unless explicitly stated **Payment Processing:** - Payments are processed through secure third-party payment gateways (Cashfree, Razorpay) - You authorize us to charge your selected payment method for donations - You are responsible for any bank charges or payment gateway fees - We are not responsible for payment gateway failures beyond our control - All payment information is encrypted and handled securely per PCI-DSS standards

Tax Benefits and Receipts

**80G Tax Benefits:** - Prajaahita Foundation is registered under Section 80G of the Income Tax Act - You will receive a tax receipt for your donations as per Indian tax regulations - Tax receipts are issued for donations above ₹500 - It is your responsibility to claim tax deductions with the Income Tax Department - We are not responsible for any changes in tax laws affecting donation deductibility **Receipt Delivery:** - Tax receipts are sent to your registered email address within 7-10 business days - You must maintain these receipts for tax filing purposes - Duplicate receipts can be requested by contacting our support team - If you receive a refund, the corresponding tax receipt becomes invalid

User Conduct and Prohibited Activities

**You agree NOT to:** - Use the Platform for any illegal or unauthorized purpose - Violate any laws in your jurisdiction (including but not limited to copyright laws) - Transmit any worms, viruses, or destructive code - Attempt to gain unauthorized access to any part of the Platform - Interfere with or disrupt the Platform or servers - Collect or store personal data about other users - Impersonate any person or entity - Use the Platform to solicit donations for other organizations - Create fake donation records or engage in fraudulent activities - Harass, abuse, or harm other users or our staff **Consequences of Violation:** We reserve the right to: - Suspend or terminate your account immediately - Report illegal activities to law enforcement - Pursue legal action for damages - Refuse service to anyone at any time

Intellectual Property Rights

**Our Content:** - All content on the Platform, including text, graphics, logos, images, and software, is owned by Prajaahita Foundation or its licensors - Content is protected by Indian and international copyright, trademark, and other intellectual property laws - You may not reproduce, distribute, modify, or create derivative works without our written permission - The S.O.I.L name, logo, and all related marks are trademarks of Prajaahita Foundation **Your Content:** - You retain ownership of any content you submit to us (testimonials, feedback, etc.) - By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content - You represent that you own or have the necessary permissions for any content you submit - We reserve the right to remove any content that violates these terms or is otherwise objectionable

Privacy and Data Protection

**Data Collection and Use:** - We collect and process personal information as described in our Privacy Policy - By using the Platform, you consent to our data practices - We implement reasonable security measures to protect your data - We do not sell your personal information to third parties - You have rights regarding your personal data as outlined in our Privacy Policy **Third-Party Services:** - We use third-party services for payment processing, analytics, and email communications - These services have their own privacy policies and terms - We are not responsible for the practices of these third-party services - You should review their policies before using our Platform

Additional Important Terms

Disclaimers and Limitations of Liability

Platform Availability: We strive to keep the Platform available 24/7, but we do not guarantee uninterrupted access. We may suspend, withdraw, or restrict access to the Platform for maintenance or other reasons.

No Warranties: The Platform is provided 'as is' without warranties of any kind, either express or implied. We do not warrant that the Platform will be error-free or virus-free.

Limitation of Liability: To the maximum extent permitted by law, Prajaahita Foundation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Indemnification

You agree to indemnify, defend, and hold harmless Prajaahita Foundation, its directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

Your violation of these Terms and Conditions
Your violation of any rights of another person or entity
Your use or misuse of the Platform
Any content you submit to the Platform

Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of India. You irrevocably submit to the exclusive jurisdiction of the courts in Ottapalam, Kerala for the resolution of any disputes.

Any legal action or proceeding relating to your access to, or use of, the Platform shall be instituted in the courts of Ottapalam, Kerala.

Dispute Resolution

Informal Resolution: If you have a dispute with us, we encourage you to first contact us at support@soil.org.in to try to resolve it informally.

Arbitration: If we cannot resolve a dispute informally, both parties agree to resolve disputes through binding arbitration in Ottapalam, Kerala, in accordance with the Arbitration and Conciliation Act, 1996.

Class Action Waiver: You agree to bring claims against us only in your individual capacity and not as part of any class action.

Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify users of any material changes by:

Posting the updated terms on this page
Updating the 'Last updated' date
Sending an email notification to registered users (for significant changes)

Your continued use of the Platform after changes become effective constitutes acceptance of the revised terms.

Termination

By You: You may terminate your account at any time by contacting our support team. Termination does not affect any donations already made.

By Us: We reserve the right to terminate or suspend your account immediately, without prior notice, for any violation of these Terms or for any other reason we deem appropriate. Upon termination, your right to use the Platform will immediately cease.

Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect.

Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Prajaahita Foundation regarding your use of the Platform and supersede all prior agreements and understandings.

Force Majeure

We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including but not limited to mechanical, electronic, or communications failure or degradation, natural disasters, war, terrorism, strikes, or government actions.

Assignment

You may not assign or transfer these Terms and Conditions or your account to any third party without our prior written consent. We may assign or transfer these Terms without restriction.

No Waiver

Our failure to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. Any waiver of any provision shall be effective only if in writing and signed by an authorized representative of Prajaahita Foundation.
